Dui Offenders – Harsh Rehabilitation VS Harsh Legal Punishment

In Utah, even if you don’t get arrested for drunk driving you might still have to call your mom from jail — sort of. The Utah Highway Patrol and some local bars hope letting people practice an uncomfortable call from the local lockup will help dissuade drinking and driving. A phone number has been set up to recreate what it would feel like to make such a call. After dialing 1-877-JAIL-FON, the caller is given the option to talk to a hysterical mother or a disapproving father, among others. A prerecorded message then plays one end of what the conversation might sound like, with the caller filling in the other half. Slogans associated with the campaign include “Getting a DUI is easy, calling your mom from jail is hard.”

Methods like this seem to be having a much great impact than the recent harsh legal punishment coming from states like Arizona.  While most states are more interested in safety for there tax paying citizens, states like Arizona are becoming cash hungry giants.  With photo radar in the same branch, recently things have gotten out of control in these areas. From false dui arrests to dirty cops, it doesn’t seem like Arizona is interested in the safety of it’s people, but more the cash it generates.  Veteran Hollywood Police Officer Dewey Pressley said he hated lying. But if bending the truth a little would keep a fellow officer out of trouble, well, he was all for it. A dashboard police camera video that surfaced recently showed an officer chuckling as he wrote a fake police report, calling his creativity “a little Walt Disney” so another officer wouldn’t get in trouble for rear-ending a 23-year-old woman’s car in February. Pressley and four others have been suspended with pay pending an investigation after video of the accident and the officers’ attempt to cover it up became public last week, the latest Internet sensation in a line of unsettling police dash cam videos. On the video, the officers, with calculating authority, are heard laughing about how drunk 23-year-old Alexandra Torrens-Vilas is and how they plan to “hang her out to dry” so the officer that hit her car doesn’t get in trouble. “I’m gonna tell you exactly how to word this so we can get him off the hook,” Pressley says on the video. Later he remarks: “I don’t like making things up ever because it’s wrong but if I have to bend it a little to protect a cop I’m gonna.” In the report, Pressley wrote Vilas got in the left lane and slammed on the brakes and blamed her for the accident.

While we continue this full front money war with the local politicians, it’s time we start thinking outside the box.  While stealing millions of dollars from citizens seems like the simple way, why not get these offenders involved in the community with some community service hours.  In these harsh economical times most people just simply don’t have the money to pay.  Instead of forcing bankruptcy, house lose, job loss, and scrounging for food, why not just give dui offenders a great amount of hours, getting them out of their usual drinking habits. This way offender’s are receiving harsh rehabilitation, not harsh legal punishment.

In May 1980 a young 13 year old girl was hit and killed by a drunk driver in a hit and run as she walked along a sidewalk on her way to a festival. Through the grief of losing her daughter, Candy Lightner immediately took action in trying to find more about the driver that killed her daughter from files at the DMV and information from a Las Vegas DUI attorney and Las Vegas DUI lawyer and if he was a frequent drunk driver. This started the cause that many are aware of today known as MADD which stood for Mothers Against Drunk Driving.

With a large amount of grief and anger over her daughter’s death, Candy Lightner along with her friend, Sue LeBron-Green wanted to change not only the laws that seemed ineffective in keeping drunk drivers off the road or from repeating their offense but also in changing the attitude of society that was quite different in the early 1980′s. Back then, driving after consuming alcoholic drinks was not considered a bad thing and something almost everyone did at one time or another. The fight to not only change laws but everyone’s attitude toward something that is considered acceptable was a huge battle for these two mothers.

They started by going to politicians who seemed to be aware of the statistics but took no action to change them. This mother had a compelling story to tell and rather than just tell it, she used horrifying photographs of car crashes that resulted from a drunk driver to try to make those statistics come to life. Not only were they fighting government but also the powerful industries that were more concerned about profit over safety. They seemed like uphill battles but from their grief and passion these two women fought on and on and got many followers to join them in this fight.

In just three years, they proved that their fight and their MADD organization was making a difference with having traffic safety and victims rights legislation passed. The more they fought, the more publicity they got and after only four years from when her daughter was killed, Candy Lightner’s MADD non-profit group had 330 chapters in 47 states. People were tired of losing their loved ones in fatal alcohol related crashes and this group seemed like the way to change it. In 1988, the largest and worst alcohol related crash took place in Kentucky where 24 young people were killed when their church bus was hit by a drunk driver and it burst into flames. The media attention of this horrible event helped MADD’s mission to continue to change not only the laws but the attitude that Americans had toward drinking and driving.

Another thing that MADD felt was important to have changed was the drinking age in the United States. They noticed that the states with lower drinking ages also had a much higher frequency of drunk driving crashes. Because of MADD, traffic fatalities have dropped from 30,000 in 1980 to less than 17,000 today.

According to the Journal Archives of Surgery published on March 17th which found out that, even after a year of injury in a car accident, slip and fall or other kinds of accidents, 63 percent reported that they still had substantial pain related to the injury. In this study over 3,000 patients between the ages 18 to 84 were taken into account, who had survived a traumatic injury.

The various kinds of injuries include broken limbs, chest or abdominal trauma, injuries in motor vehicle crashes, slip-trip & fall accidents and other accidents. The most common areas of pain identified were the joints and limbs (44 %), the back (26 %), the head injuries (12 %), and the neck injuries (7 %).

A Baltimore-based advocacy group called “American Pain Foundation”, said that the financial cost of chronic pain in the United States, including loss of income, health care expenses and lost productivity in the workplace, is estimated to be around $100 billion per year. Back pain is the leading cause of disability in Americans under 45 years old according to this foundation.

Auto accidents are a very common occurrence that sometimes results in injury and sometimes doesn’t. When an injury has not been incurred, some may not find it necessary to report the incident to the police, especially if no damage was done to the vehicles involved. However, an injury does not have to be recognized at the time of the crash. Some injuries can develop days and even weeks later. It is similar to when you are lifting weights and you wake up the next morning with soreness in your muscles. You didn’t feel the pain while you were doing it, but you definitely feel it the day after.

When a non-injury motor vehicle crash occurs, it is important to exchange information with the other driver in case a health issue or vehicle issue does come about later on. However, it is a good idea to go ahead and call the police and listen to what they suggest should be done if no injury or vehicle damage occurred. They may elect to come investigate the crash or may suggest simply exchanging information between drivers.

However, if there was no injury and there was vehicle damage, it is very important to call the police because of insurance purposes. The police must file a report regarding who was at fault in the accident so that the one who was not at fault can turn the report and any other information over to the insurance company. If this is not done, the driver who was not at fault in the accident will have to pay any deductibles associated with their insurance. That is why it is in their best interest to seek payment from the insurance company of the one who was at fault in the accident.

This makes It very important that the insurance companies know who is at fault in order for the repairs to be paid for by the proper party. The most reliable way of learning who was at fault is through the police report. The police report outlines the stories of both drivers, which can determine who was truly at fault in the accident. The report includes any witness accounts that can be very beneficial to the case of the driver who was not at fault.

But again, listening to what the police have to say is very important, but if you absolutely feel that a police report should be filed, you can ask them to send someone and that you will wait for them to arrive. If the impact caused any kind of jerking of the neck or shoulder, then it is important that that be documented in case an injury develops later on as a result of the crash. At other times, it is up to the two parties involved in the crash as far as what to do, but this can be somewhat risky depending on the impact of the crash. Plenty of minor fender benders have turned into a case of whiplash because it doesn’t really take much to cause a neck injury even if the car didn’t receive a scratch. All it takes is for the vehicle to be hit in the right way for someone to become severely injured from a car accident.

So use your head when dealing with a non-injury motor vehicle crash situation. It can be a very upsetting experience, so it may seem easy to just walk away, but it is important to evaluate the situation and see if it is necessary to call the police. To be extra cautious, it is a good idea to go ahead and call them and have a record of the incident in case it is needed in the future.
