Does your license get permanently revoked if you were convicted of vehicular manslaughter as a teen?

5 years ago My sisters ex-boyfriend was a drunk driver at the age of 17 and crashed the car he was driving and his friend who was the passenger didn’t survive. he was convicted of vehicular manslaughter and served 2 years.. he is now 22 and My sister heard that he was taking some DUI classes and that he was working on getting his license.. Does this sound right? I would think that he would have his license revoked permanently. I haven’t been able to find any info online so I figured id ask here. We live in California.
Thanks in advance

Unfortunately, probably not. I think you should. In fact, I think even if you don’t kill anybody, you ought to lose your license permanently on a second DUI. If you haven’t learned your lesson the first time, you’re probably just a vehicular manslaughter waiting to happen.

I just received my first DUI in Orange County CA. My BAC was .20. What consequences am I looking at?

Received my first DUI last weekend. My BAC was .20 which is high. I am thinking of getting an attorney, but I would like to know if it is worth it. I would appreciate any advice.
Do I have to worry about jail time?

In Orange County California,

.20 + is an enhancement which requires 48 hours jail time, community service, and a 9 month alcohol program. Whether you actual go to jail for those additional 48 hours depends what court you’re out of and what judge you’re before.

Generally, when I get cases such as these, I try to get credit for time serve, try to get you out of the community service, and reduce the amount of alcohol school you’re looking at. Generally, it’s a “damage control” situation unless you can run a motion to dismiss.

DMV, well, DMV can be won with paperwork technicalities, so you never know if your DMV case can be won just on BAC levels.

You can always hire an experienced DUI attorney to try to get you out of the DUI, appear at court on your behalf, and minimize the impact of this DUI on your life.

If you need more helpful information regarding the consequences of your DUI in Orange County California, Call 877-717-2889 to speak to an experienced Orange County DUI attorney free of charge. I am available evenings and weekends.

Many of us have fond childhood memories of dad loading up the station wagon or van and heading out of town for a long week-end.

For some the destination was a lakeside campsite, but for many it was the summer cottage or cabin by the lake. For others it was a Winter activity that brought with it the long-anticipated excitement of driving up to the favourite mountain and throwing open the doors to a modest old ski lodge that one could call home for the next week or so. But unless one was lucky enough to inherit dad’s cabin, the thought of purchasing one piece of recreational paradise can be daunting for most young families.

With prices still on the rise and demand for vacation homes brisk notwithstanding the general slowdown in real estate, there are a few bright lights for homeowners looking to pick up a second home or recreational property.

The Canadian Mortgage And Housing Corporation has instituted recently a new program that will provide Homeowner Mortgage Loan Insurance for borrowers with more than one residential property. This means that Purchasers can now obtain a mortgage insured by the Canadian Mortgage And Housing Corporation on a recreational property with as little as five percent down.

Traditionally getting institutional financing for a vacation property was a challenge, because lenders typically based their lending decisions on the risk of reselling this type of properties. As many second homes are located outside urban centers and, more often than not, in remote rural or coastal areas they might have limited resale potential, which from a mortgaging point of view increased the risk of financing. To mitigate this risk, lenders would require borrowers to put up more money down – as much as thirty-five percent or more, in fact. Even well-known and popular destinations such as Whistler, British Columbia required a minimum of twenty-five percent downpayment.

But lifestyles are changing and these changes affect decisions that real estate consumers make regarding how and where to live. So the Canadian Mortgage And Housing Corporation has made a move to put vacation properties within reach of more people. With a constant and steady increase in demand for this type of properties, the Canadian Mortgage And Housing Corporation has determined that the market is such that it is willing to insure lenders against potential losses. This is welcome news for those who have been longing to get a recreational property but did not want to wait until retirement to come up with the downpayment.

All Canadian Mortgage And Housing Corporation’s products are permitted to be used with the Homeowner Mortgage Loan Insurance and since most major institutional lenders already have their own recreational property mortgage products, consumers have the flexibility to choose the type of financing that is right for them.

However, as with most types of financing, there are some key limitations that is important to be clear on. The purpose of the Homeowner Mortgage Loan Insurance is to make it more feasible for consumers to purchase a second home. It is important to distinguish between a second home and a rental property. The Homeowner Mortgage Loan Insurance is not intended to allow an investor to purchase a rental property with five percent down. The guideline states that at initiation the real capital asset that secures a mortgage insured by Canadian Mortgage And Housing Corporation must be intended for occupancy at some point during the calendar year by the borrower or a relative of the borrower on a rent-free basis. If a rental income is anticipated from the property at a future date, it will not be calculated for the purpose of assisting the Purchaser to qualify for the loan.

The location of the property is not restricted to major resorts or popular vacation spots, but there are some general requirements that apply as well. For instance, the recreational property must be suitable for and available for year-round occupancy. Properties that are constructed for seasonal use or have seasonal access are not eligible. As such, vacation cottages located on an island must have year-round bridge or ferry access. And finally, timeshare interests, life leases and properties in rental pools are not eligible.

The Canadian Mortgage And Housing Corporation’s website can be found at http://www.cmhc.ca/

First offense DUI in California. What should I expect at my arraignement? Jail time?

I’m a full time student and received a DUI a few months ago. I also had .20 BAC and wrecked my vehicle. No one was hurt. What should I expect at the arraignment? Will I have to go to jail immediately after or what? There was also some property damage but my insurance covered it. I created a huge shit storm.

first offense, probably a crap load of fines, a billion hours of community service and an alcohol education class, and a year suspension of your license.
unless your under 21, then its suspension until you are 21.
also, 1 year of probation.

second offense was all of the above, and 30 days work furlough for my friend in California, plus three year license suspension, a breathalyzer installed in car, and three years probation.

sometimes, after your initial license suspension, they will let you drive to school, work, and back with a breathalyzer.

you might get breathlyzer on your first offense, I highy doubt any jail time, unless you have three strikes or something.

Second DUI charge in 5 years with a BAC of .14 in Orange County, CA.?

A friend of mine just had this happen on the Newport Beach peninsula. Never intelligent thing to drink and drive – I do not advocate – I’m only seeking advice from others whom had to deal with this experience. I’m concerned with the court proceedings – family is out of work and has no finances to get a lawyer. Thank You in advance.

Sorry man but he is SOL, been there done that but I had the cash to fight the charge and had it reduced.

The problem is that he blew and thats all that matters, never ever blow or do a field sobriety test. Take on a public defender for free accept the plee deal. Ask for community service and probation time instead of fines or even ask if he can serve a week in county and that will keep him from having to do probation, CSR and possibly the fines, seeing that he is not working.

Problem with Cali is they are hardasses on DUIs and hes looking at more than 10K in court costs and other fees just to keep his license.

In texas where I am we have to pay 2K each year for 3 years in order to keep our license after a second offense. I think cali is much higher.

He will prolly be looking at an ignition interlock as well which will run about $75 – $100 per month.

Tell him to get to AA immediatly even if he does not plan to stick with it. Have the person at AA sign a card that proves that he was there, tell him to get a sponser, and do 90 meetings in 90 days. Get all the court classes completed before his next court date. If the DA sees that he is trying to better himself then there is a small possiblity that he will go slightly easier on him, but if your boy sits and does nothing then the DA will pound him as hard as he can.

Good luck
