I just received my first DUI in Orange County CA. My BAC was .20. What consequences am I looking at?
Received my first DUI last weekend. My BAC was .20 which is high. I am thinking of getting an attorney, but I would like to know if it is worth it. I would appreciate any advice.
Do I have to worry about jail time?

.20 + is an enhancement which requires 48 hours jail time, community service, and a 9 month alcohol program. Whether you actual go to jail for those additional 48 hours depends what court you’re out of and what judge you’re before.
Generally, when I get cases such as these, I try to get credit for time serve, try to get you out of the community service, and reduce the amount of alcohol school you’re looking at. Generally, it’s a “damage control” situation unless you can run a motion to dismiss.
DMV, well, DMV can be won with paperwork technicalities, so you never know if your DMV case can be won just on BAC levels.

I received a DWI in Texas back in 2003. I have since then moved to California and obtained a drivers licence from Ca with a different number. When i applied for a insurance the company said i had a perfect driving record. About a week ago I got pulled over once again for a DUI and now awaiting court. Penalties for 1st affenders are lesser than 2nd, now my question is, should i mention my 1st offense and hope it doesnt show up on Ca driving record or should i keep my mouth closed and hope it doesnt come back to haunt me? please help!!!!!!

The problem is that he blew and thats all that matters, never ever blow or do a field sobriety test. Take on a public defender for free accept the plee deal. Ask for community service and probation time instead of fines or even ask if he can serve a week in county and that will keep him from having to do probation, CSR and possibly the fines, seeing that he is not working.
Problem with Cali is they are hardasses on DUIs and hes looking at more than 10K in court costs and other fees just to keep his license.
In texas where I am we have to pay 2K each year for 3 years in order to keep our license after a second offense. I think cali is much higher.
He will prolly be looking at an ignition interlock as well which will run about $75 – $100 per month.
Tell him to get to AA immediatly even if he does not plan to stick with it. Have the person at AA sign a card that proves that he was there, tell him to get a sponser, and do 90 meetings in 90 days. Get all the court classes completed before his next court date. If the DA sees that he is trying to better himself then there is a small possiblity that he will go slightly easier on him, but if your boy sits and does nothing then the DA will pound him as hard as he can.
