DUI, Drunk Driving and Hispanics, A Few Statistics

The Hispanic population has grown by leaps and bounds over the last decades and promises to continue on its same course well into the next decades.  According to a paper published by the National Highway Transportation Safety Administration in 2002, Hispanics are often disproportionately impacted by drunk driving.  The Hispanic community is united in their opinion that drunk driving is a problem and that something should be done in order to curb its negative effects.  A poll among the Hispanic population in the United states revealed that over 90% believe that drunk driving is a very serious problem that must be addressed.

The statistics also show a need for a focus on the Hispanic population.  Many who come to the US may not be well versed in the traffic safety laws.  Other factors may expose the Hispanic community to a disproportionate level of risk from DUI.  Whatever the reason, below are some of the statistics reported by the NHTSA regarding Drunk Driving and Hispanics:

1. Motor Vehicle crashes are the single leading cause of death for Hispanics between the age of 1 and 44.

2. US-born Hispanics are about three times more likely to drive after drinking than are immigrant Hispanics.

3. Between the years of 1990 and 1194, approximately 12.7% of all alcohol related traffic fatalities were Hispanic persons.

4. Hispanic men have a higher rate of having ever been arrested for DUI than do blacks or whites, and on average Hispanics believed the number of drinks needed to affect driving was higher than what blacks and whites believed.

While some of these statistics are stark and troubling, the good news is the resolve within the Hispanic community to reduce drinking and driving.  According to the same article, 94% say that something should be done to protect their community from what they see as a major threat to public safety.  NHTSA has been working hard with these communities to improve education and knowledge concerning how drunk driving is affecting their communities and about traffic laws and other methods for knowing when it is safe to drive and when it is not.

Drunk Driving Accidents – What You Must Know

Drunk driving accidents are completely preventable. They are also taken very seriously and drunk drivers face extreme punishment under the law. Most states have strengthened their drunk driving laws to include severe punishments for even first time offenders. Understanding Drunk Driving

Many people are guilty of drunk driving. For a lot of those people, they were unaware that they were drunk enough to be considered over the legal limit. The legal limit for the amount of alcohol a person can have in their system while driving varies from state to state. Most states, though, have very strict limits.

In some states, a person is considered drunk if they have consumed a 12 ounce beer, 5 ounces of wine or a 1.5 ounce shot of whiskey. Many people think that having one drink is fine and that they are legal to drive, but as you see, that is often not the case. Even if you are in a minor accident, being found to be under the influence of alcohol means you will be charged with drunk driving. You will face harsh penalties.

Defenses of Drunk Driving

If you are involved in an accident and have been charged with drunk driving you will need to seek legal assistance right away. There are some defenses that can be used to fight drunk driving charges. Such defenses can help keep you from losing your license or from going to jail. Only an experienced lawyer, though, can help you to win your case in court.

While you may not be able to completely get off from the drunk driving charges, you can still fight lawsuits from the other parties involved in the accident. One such defense that you can use to keep another party from recovering damages is contributory negligence. Contributory negligence is when the other person’s actions somehow contributed to their injuries.

Comparative negligence is another form of defense to prevent a party from claiming damages. It reduces the amount of judgment based upon the fault of the plaintiff. For example, if the defendant is found guilty for 60% of the accident then the plaintiff can only claim damages of 40%.

If you are being sued by a passenger that was in your car then, depending on the law in your state, you may be able to use the defense of contributory negligence or comparative negligence or assumption of the risk. This basically means that your passenger knew when getting into the vehicle that you were under the influence and therefore is somewhat responsible for their own injury.

When you have been involved in a drunk driving accident as a result of your own actions, you must step up and take responsibility. You should get help for your drinking problem. If it was a simple oversight and you were not intoxicated, but merely above the legal limit then you should take care in the future to avoid getting yourself in such a situation. Drinking and driving is very serious as every year there are countless people who lose their lives as a result of drunk driving.

Dramshop Claims

If you serve alcohol at a party and one of your guests causes an accident after the party, you could be sued. This is sometimes covered under state Dramshop laws.

Don’t let your guests leave after drinking until you are completely satisfied that they are sober. Have someone at the party keep the keys. That person will remain sober and verify that people who leave are ready to drive. Some wise hosts have their guests spend the night to make sure they don’t leave while intoxicated.

M.I.P in Oklahoma.. Please look!?

I was at a basketball game and we got detained for mip the adult whom bought it for us also was issued a ticket. The ticket was city ordinance or however you say it, anyways i am almost off of probation for my dui i had over three years ago and this was in a different county then i get the mip. So what im asking is the police issued us the citation and said that we needed to pay it, i asked him if i would lose my licenses and he said that he wasnt going to turn it in to the motor but he doesnt know about the station. We are paying the fine immediantly and pleaing no contest i guess. My question with this info is do you think i will lose my license?

I actually had a DWI while I lived in Oklahoma for a brief time so I know that sucks. I don’t think that they would take your license away because MIP is not a driving offense. They didn’t give you a BAC test again did they? I think you’ll be fine especially since he said he wouldn’t turn it in. I say pay the fine ASAP. All they really want is the money anyway. You’re not a murder or drug dealer.

Did your high school host this event and did it affect you?

This question is about EVERY FIFTEEN MINUTES.

I’m writing a paper on the drunk driving awareness program ‘Every Fifteen Minutes’ for my Public Health 103 class. I recently flew home to participate in my brother’s event, he was the drunk driver, and wanted to know how many people have participated in this and how they felt about it.

I am curious to know:
1. How old you were when you saw this event at your high school?
2. What state is your school in?
3. Did you have your license yet?
4. Did it change your feelings/opinions/personal actions when it came to alcohol and driving?
5. Do you believe this is an effective program for deterring teenagers from drinking and driving?
6. Did you have a role in the program other than a spectator (coordinator, living dead, related to a participant etc)?

Any other comments you have would be great!

4. no, as I never had the desire to experiment with alcohol in the first place – I had some common sense

6. only a spectator, although a couple of the “dead” were acquaintances of mine and none were close friends.

As a social outcast, it didn’t make much difference to me if the “popular” kids were supposed to be dead or if I was the one who was supposed to have been “dead” as hardly anybody would’ve noticed me anyway. This program didn’t have much effect on me, other than strengthening my beliefs in not messing with alcohol, especially after one of our math teachers (Mr. Woody) brought in what was left of his car after a drunk driver plowed into him, nearly paralyzing him. To me, first-hand accounts like Mr. Woody’s are more effective than hearing someone quoting statistics.

Pretty much, its all up to the students themselves. Self-control is there for a reason, yet so many choose to ignore it so they can seem “cool” or more grown-up, which is a crock. If someone wants alcohol badly enough, they’ll find a way to get it. Desperation can do weird things to a person.

That makes me think of a wreck on our property line from last year where some girl had taken her boss’s vehicle from work (along with her boyfriend) and they seemed to be drunk, if not on drugs (or both, as they were coming from the direction of a known meth cook in our town) and were driving way too fast and nearly rolled the boss’s vehicle into a creek and did quite a bit of property damage. The girl driving wasn’t wearing her glasses and she wasn’t licensed and she was paranoid about going to jail and her boyfriend didn’t seem to care. Needless to say, that girl was fired and the boss wasn’t too thrilled about them joyriding in his vehicle when she should have been at work, actually on the clock. As far as I know, they were both charged with vehicle theft and possibly some drug charges, but I haven’t been paying attention to that particular case.

California DUI misdemeanor or felony?

I head that in 1981 a change in California law , which became effective 1/1/1982, made all arrests for DUI a felony and there no longer was such a thing as misdemeanor DUI in California… it this true. Did that happen and/or was that change repealed since.

In California a DUI can be charged as EITHER a midsdemeanor OR a Felony at the discretion of the office who is prosecuting the case.

A basic DUI with no past criminal record will usually be charged as a misdemeanor…

But prior DUI convictions, injuries to pasengers or others, or deaths as well as some other circumstances may elevate the DUI to a felony…
